Rights and Duties of Parents in a Preschool Institution (Kindergarten)
In this article, I will attempt to briefly explain the rights and duties of parents as I see them from an attorney's perspective. The conditions for the provision of early and preschool care and education in Georgia are regulated by the Law of Georgia "On Early and Preschool Care and Education." Preschool care and education refers to the period from the age of 2 until entry into the first grade of the primary level of general education;
The care and education of children in Georgia are free of charge, as are their meals (to establish the norms for the organization of meals and the nutritional value of the diet in the institution, the Ministry approves a technical regulation upon submission; to establish the rules for observing sanitary-hygienic norms in the institution, the Ministry develops a technical regulation and submits it for approval to the Government of Georgia, while the Legal Entity of Public Law — the National Food Agency — verifies food safety in the institution in accordance with the rules established by Georgian legislation). It is also interesting to note that access to the said education is voluntary; accordingly, it is the parent's choice whether their child will utilize it;
The language of instruction in the institution must be Georgian, and in the Autonomous Republic of Abkhazia, also Abkhazian. Additionally, in areas where an ethnic minority predominates, instruction may also be in another language. The institution is obliged to ensure that the caregiver-pedagogue, caregiver, and other personnel possess and utilize methods of non-violent treatment and care, and that they are informed about the consequences of violence against a child and the forms of responsibility. This means that any form of violence is prohibited in kindergarten; in the event of violence, please contact law enforcement agencies immediately, as well as an attorney who will protect your rights;
An institution that wishes to provide early and preschool care and education services is obliged to undergo authorization. Undergoing authorization means fulfilling the respective obligations required by law. The term of authorization for an institution is 4 years. Furthermore, the law distinguishes between an institution (which is a legal entity but is so-called private) and another it terms public, the founder of which is the municipality. Moreover, a public institution annually submits annual and financial reports to the founder according to the plan established by the municipality. Also, the standards for exercising control over the activities of a public institution by the relevant structural unit of the municipal city hall and/or by a non-entrepreneurial (non-commercial) legal entity founded by the municipality are established by a decree of the Government of Georgia. In the event that parents/legal representatives of no fewer than 10 children involved in the program appeal to the municipality, the municipality is obliged to conduct an unscheduled inspection of this institution;
A public institution creates a consultative council on an active public (pro bono) basis. The consultative council consists of 7 members: 5 parents/legal representatives and 2 caregiver-pedagogues. It reviews the financial expenditures and property asset management issues of the public institution and provides appropriate recommendations to the administration of the public institution; also, in accordance with the charter, it reviews complaints from the children's parents/legal representatives and provides recommendations to the administration of the public institution to resolve problems;
Groups for preschool care and education must be staffed according to the following maximum capacities: in a group of children from 2 to 3 years old, there may be no more than 25 children; in a group of children from 3 to 4 years old, there may be no more than 30 children; in a group of children from 4 to 5 years old, there may be no more than 30 children. At the same time, the number of caregiver-pedagogues/caregivers in each group must be determined by the following ratio: in a group of children from 2 to 3 years old, the ratio of caregiver-pedagogues/caregivers to children must not exceed 1:13; in a group of children from 3 to 4 years old, the ratio must not exceed 1:15; in a group of children from 4 to 5 years old, the ratio must not exceed 1:15;
During the educational period, a public institution must ensure universal access to early and preschool care and education for all children, and the involvement of the children's parents/legal representatives in the process of providing early and preschool care and education services. It is obliged to promote the child's sporting activities during the preschool care and education process, the goal of which should be the establishment of a healthy lifestyle for the child at an early age;
