Temporary Incapacity for Work (the So-Called "Sick Leave"): Rules and Conditions of Compensation
During the legal relationship between an employer and an employee, we occasionally encounter grounds for the suspension of employment relations, such as vacation, temporary incapacity for work, etc. While providing legal services, I am frequently asked questions as an attorney regarding temporary incapacity for work, which is more commonly known as being on "sick leave" (the so-called "bulletin");
In today's article, I will attempt to briefly overview temporary incapacity for work from an attorney's perspective and provide a legal assessment regarding the rules and conditions of its compensation. First and foremost, it must be stated from the outset that during temporary incapacity, the employee is not obliged to perform their assigned labor duties. This means that, provided the relevant grounds exist, the employer does not have the right to dismiss the employee (terminate the employment contract) solely because the person is temporarily incapacitated and therefore unable to perform the work/obligation. There is a "malicious" practice where employees are dismissed precisely for this reason, which is nothing more than the unlawful exercise of a right, placing the "weaker" party in an even more vulnerable position. On the other hand, in some cases, the law grants the employer the legal right to terminate the employment contract if the temporary incapacity exceeds a certain duration; however, this issue is a subject for another discussion, which I will try to cover more extensively in the future (a video lecture/explanation on this topic can be viewed here: Temporary Incapacity GGK Lawyer);
The Organic Law of Georgia, the "Labor Code," does not directly regulate the compensation rules during temporary incapacity. However, the rules and conditions for compensating temporary incapacity are explained and regulated by the Order of the Minister of Labor, Health and Social Affairs of Georgia No. 87/n, dated February 19, 2009 (Tbilisi) "On the Approval of the Rule for Appointing and Issuing Benefits due to Temporary Incapacity for Work." It is this specific order/rule that regulates the appointment, calculation, and issuance of temporary incapacity benefits for employees defined by the Labor Code of Georgia and for state/public servants defined by the Law of Georgia on Public Service;
Question 1: When is a person granted a temporary incapacity benefit?
Answer 1: A person (whether employed in the private or public sector) is granted a benefit due to temporary incapacity if it is caused by the following reasons:
a) Loss of working capacity caused by a disease or injury;
b) Caring for a sick family member;
c) Quarantine;
d) Prosthetics.
Question 2: Who is responsible for the appropriate compensation during temporary incapacity?
Answer 2: The appointment, calculation, and issuance of the temporary incapacity benefit is carried out by the respective employer in the case of a standard employee, and by the respective budgetary (treasury) institution in the case of a public servant. Additionally, the responsibility for the accuracy of the appointment, calculation, and issuance of the temporary incapacity benefit rests with the respective employer/institution.
Question 3: For what period is the temporary incapacity benefit granted to a person?
Answer 3: From the very first day of the certificate issued by the hospital (the hospital certificate implies the "sick leave"). In the event that a person's temporary incapacity begins while they are on vacation, the temporary incapacity benefit is paid for the entire period of the temporary incapacity. In this case, the vacation days are postponed by the number of days indicated in the sick leave certificate. This means that if a person went on vacation on the 1st of the month for 20 days, and on the 10th day their temporary incapacity was established, the benefit is assigned from the 11th day, and the remaining 10 days of vacation will be added and taken from the 20th to the 30th of the month;
Question 4: In what cases is a person not granted the temporary incapacity benefit?
Answer 4: A person who sustained an injury while committing a criminal act or intentionally caused harm to their health; if they violated the medical regimen established by the attending physician; and in other corresponding exceptional cases. It is also possible that a person was indeed temporarily incapacitated, but if they fail to submit the confirming document (sick leave certificate) to the relevant place within 3 months after its closure, they will not be granted the benefit.
Question 5: What is the amount of the benefit, and how is it calculated during temporary incapacity?
Answer 5: The base amount used is the remuneration that the employee earns. Specifically, the base for calculating the amount of the temporary incapacity benefit to be issued to the employee is the remuneration defined by the employment contract. This means that the total amount of the benefit is determined cumulatively, by multiplying the average daily salary in the month indicated in the sick leave certificate by the number of working days missed due to incapacity in that given month. For example: If a person is granted a benefit for 10 days, out of which 7 were working days, and there were 22 working days in total in that month, and the employee's salary is 1000 GEL. Accordingly, 1000 / 22 = 45.45 GEL per day. This daily amount is then multiplied by the missed working days: 45.45 * 7 = 318.18 GEL. The purpose of adhering to this principle is to ensure the employee receives an amount equivalent to their salary; a minor discrepancy may be forgiven to the employer, but a significant reduction in the salary amount must not occur. In some cases during my legal practice, I encounter a malicious practice where, upon presentation of the sick leave certificate, the employer simply refuses to issue any funds to the employee;
Question 6: On what basis does the employer issue the incapacity benefit?
Answer 6: The employee submits the hospital certificate (the so-called "sick leave") to the employer (or to the relevant person in the case of a public servant). The employer is obliged, within 10 working days from the submission of the sick leave certificate, to either pay the temporary incapacity benefit or send a written notice to the employee regarding the refusal to issue the benefit. In this notice, the employer must state the grounds for the refusal, which the employee, in turn, has the right to appeal.
Question 7: What is not taken into account when calculating the benefit?
Answer 7: One-time benefits, bonuses and material rewards, overtime pay, and remuneration for one-time work that does not constitute the payment received for the primary job.
Question 8: Is temporary incapacity considered as part of a vacation/vacation period?
Answer 8: No, the period of temporary incapacity is not counted as part of the vacation period; therefore, "being" in both states simultaneously is impossible;
Towards the end, I will briefly touch upon the suspension and termination of the employment contract due to temporary incapacity. The employment relationship is suspended during temporary incapacity if its duration does not exceed 40 consecutive calendar days, or if the total duration within a 6-month period does not exceed 60 calendar days, unless otherwise defined by the employment contract (i.e., the parties agreed on a longer term). If the period of incapacity exceeds 40 consecutive calendar days, or if the total duration within 6 months exceeds 60 calendar days, and simultaneously, the employee has utilized the leave provided by Article 21 of this Law, the employer has the right to terminate the employment contract. My personal opinion as an attorney is that this is unconstitutional, because in such a case, the suspension of the employment relationship occurs due to a reason independent of the person; otherwise, the Labor Code protects the interests of the employer rather than the employee (there may be different solutions, but this is a topic for separate deliberation);
This is a brief overview of what can be said about temporary incapacity for work. At the same time, there are various distinct cases in practice, so every specific case requires individual examination. However, it is mandatory for the employee to know that their temporary incapacity must unconditionally be compensated by the employer;
