  • Covert Recording as Admissible Evidence
  • Regarding covert recordings, the approach of both the courts and legal theory is unequivocal: a covert recording is inadmissible evidence because it "destroys both civil order and the fundamental principles of civil circulation." However, even in this rule, there are exceptions that explain what this is conditioned by, why a covert recording cannot be used as evidence, and that its use is possible only when exceptional circumstances are present. Let us proceed step by step;
  • Everything can be said to have started with a 2015 Supreme Court decision in case No. as-1155-1101-2014, where the Supreme Court indicated: "The fundamental right to freedom of thought protects not only the expression of a thought but also its reaching the addressee. Accordingly, the freedom of thought must be protected from third parties becoming acquainted with its content. Human rights are violated when an individual lives with the feeling that any word of theirs, any, even an unconsidered and spontaneous expression of thought, a preliminary position expressed during an evolving dialogue, or any formulation whose true meaning can only be understood if one knows the specific situation, might be used in other circumstances and in a different context. An individual must conduct private conversations without the suspicion and fear that someone will use a secret recording without their permission and against their will."
  • The Supreme Court repeated the same in another case (as-238-226-2016). At the same time, the Supreme Court indicated that: "When interfering in the private sphere, the interference must be justified and substantiated by the existence of an overriding general interest; that is, in order to determine the lawfulness of the interference, it must be evaluated whether there exists an interest worthy of protection that stands higher than the constitutionally guaranteed right to the inviolability of private life and personal communication." It is precisely the interest worthy of protection that is the most interesting aspect when a covert recording may become admissible evidence and a court decision may be made based on this evidence. The interest worthy of protection is the most important factor on the basis of which a person's interest can outweigh the interference in the private sphere, making the obtained outcome/result legally recognized;
  • As in all other cases when it is necessary for the court to explain what an interest worthy of protection means, a collision of two interests occurs: one, for the sake of which the covert recording is carried out, and the other, the intrusion into the legitimate interest of another person to an extent that it already entails bringing part of that person's private life into the courtroom. Interestingly, unlike a covert audio and/or video recording, the question has not yet arisen with such urgency as to whether correspondence via Skype (or Viber / Messenger / WhatsApp) should be considered inadmissible evidence. However, I believe the issue here lies more in the nature of the relationship present and what the presenting party wishes to prove. Because if we are talking about the admissibility of such correspondence, it is presumed that the person realizes that this correspondence is stored on an electronic medium and, therefore, can be used—unlike a covert audio or video recording, where the recording comes as a surprise to the person (case No. as-1190-1110-2017);
  • In some cases, the public interest may be so high that it outweighs the legally established obligation of confidentiality. Conversely, in such a case, it is important that the line is drawn appropriately so that, in order to protect one interest, the rights of others are not violated/infringed upon (Sergi Jorbenadze, Commentaries on the Civil Code, Article 18, p. 121);
  • In addition to the above, the court may recognize a covert recording as admissible evidence if the said covert recording:
    a)
    Can be evaluated as an action committed within the framework of self-help or "close to self-help" (regarding the limits and circumstances of self-help, see the article Limits of Self-Help). However, 4 conditions for the emergence of self-help must be met: the inability of the competent authority to arrive in time and the existence of an immediate danger of the destruction of evidence and/or the impossibility of exercising the right. All these conditions must exist simultaneously;
    b) If the covert recording is the only way to protect one's right, because otherwise the person will not be able to protect their right or there is a real danger of the destruction of all other evidence. In such a situation, creating evidence by means of a covert recording is admissible (the lack of other means is the decisive moment here; specifically, it must first be ruled out whether the person could have exercised the right otherwise, and moreover, the failure to use this right must destroy the evidence, consequently making it impossible for the party to realize their right without it);
    c) Thus, if pressure, threats, or blackmail are exerted on a person, in order to prevent an inadmissible infringement of one's own rights, and as a result of a multilateral weighing of constitutional values, an intrusion into another's private sphere may be considered justified (in connection with this, the court offers a higher standard: an action must unequivocally be carried out against the person that could and more credibly contains elements of a criminal offense; moreover, even in such a case, the multilateral weighing of constitutional values means that, regardless of the existence of this threat and how admissible the covert recording might be as evidence, it must also overcome the constitutional principle of the inadmissibility of interfering in someone else's private life);
    d) However, the aforementioned is inadmissible when the interference in another's private sphere serves not for self-help, but for imposing civil liability on the other party. And the interference in the private sphere became necessary only because the creditor of the rights and obligations did not take care in due time to create the appropriate evidence (contract, receipt, etc.). (It can be said that if a person creates any kind of evidence to impose civil liability on the other party but did not take care to conclude the appropriate contract in due time, any recording will be inadmissible);
  • And finally, the court concludes that: "In such a situation, when interference in the private sphere is unjustified, evidence obtained in this way is inadmissible evidence. The case concerned a covert audio recording made on an audio disc, which, without the permission of the other party, was covertly recorded in a situation where the plaintiff had not utilized the right guaranteed by Article 429 of the Civil Code (Article 429.1: The creditor, at the request of the debtor, upon accepting performance in full or in part, must issue a document confirming this) to request a document from the creditor confirming the performance of the monetary obligation.";
  • Such an approach by the court, on the one hand, creates an appropriate spectrum to determine what can and cannot be carried out. At the same time, the action to be carried out itself was closely linked not only to Articles 118/119 of the Civil Code (grounds for self-help) but also to Article 115 of the Civil Code (unlawful use of a right: civil rights must be exercised lawfully. It is inadmissible to use a right solely for the purpose of causing harm to another), because: "It is unlikely that there is a case where there is an abuse of a right and it is not simultaneously a violation of the principle of good faith. However, for the composition of an abuse of a right, additional preconditions are established, which narrows the scope of regulation and justifies its separate regulation". Furthermore, it is also interesting to consider the reasoning that: "Evidence obtained in violation of the law, with the mutual consent of the parties, is admissible evidence. In such a situation, decisive importance is attached to the will of the person at the expense of whose constitutional rights the evidence was obtained. The consent of the said person rectifies the defective proving carried out by the other party." Also: "Evidence obtained in violation of the law is ab initio inadmissible evidence and is not subject to evaluation. The unlawful character of the evidence is determined by the illegitimacy of its acquisition and not by the content of the evidence" (K. Meskhishvili, Covert Recording as Evidence within the Framework of Civil Legal Proceedings, Georgian Business Law Review, Edition IV, 2015, pp. 71-79);
  • Proceeding from all the above, it is possible and even permissible that a covert video or audio recording is not inadmissible evidence in all cases. Moreover, for it to become admissible evidence, certain conditions must exist, and it is precisely these conditions that create the possibility of using this evidence. It is one thing when a contractual relationship exists where a person demands the payment of a sum from another person, and the other party confirms the receipt of the sum; and it is another when threats are made against a person, they secretly record this and still sign the transaction, whereas proving the threat would be impossible without presenting the video or audio recording. Accordingly, each case or issue under consideration, like all other directions in law, is subject to evaluation based on the circumstances;
