The System Punishes You When You Are Inactive: What Does a Lawyer Advise?

A Dispute?
No one wants a dispute, but if you live in a state, it is inevitable—especially in a country where trust in legal institutions is not yet fully established. Two generations in Georgia lived in a system where "the court did not exist," and today, many still believe that "disputing is pointless anyway." The reasons behind these conditions are numerous;

The Solution?
The more we avoid disputes and shy away from transferring an issue into the legal realm, the less the dispute is "resolved." It is merely postponed to a future where no one knows how it will manifest itself. If you dispute, and if you take the right legal steps, it is not a conflict—it is a method of self-defense. If you do not protect yourself today, tomorrow may be too late. Recognizing every barrier on the road to a solution is crucial;

The System?
By "system," I do not merely mean a specific group of people holding "power." The system is the entire existing order, which inherently includes the social context. It is still a stereotype that saying "I will contact my lawyer" is an extreme measure. Simply put, contacting a lawyer is not a sign of weakness; on the contrary, it is a sign of strength. It indicates that a professional is stepping into your dispute and that you are no longer alone;

Face to Face with the State?
For me, as a lawyer, the state is a "legal phantom." In reality, the state consists of every citizen of Georgia; their unity provides us with the concept of the state. Here, too, a stereotype exists: "If I go to court or file a complaint, they will punish me more, or things will get more complicated." On the other hand, what is the alternative when the dispute is already a reality? When the state has already come knocking at your door? What is the price of a settlement or compromise? What will the state give up in exchange for you waiving your individual rights? When has the state ever conceded anything voluntarily?

Starting a Dispute?
Probably everyone has tried to start a dispute at least once, only to avoid it and postpone it for another time. Stereotypes play a major role here as well: "The judge will be on their side anyway," or "The lawyer will start the case and sign things on my behalf that I won't be able to control." A civil court is not a notary that merely stamps a document; this is why there are three judicial instances to go through. I have also heard excuses like, "I will make an influential enemy," or "They will create problems for me in other areas." All these exist solely to justify the inadmissibility of taking action;

Power?
Power is a complex category. Power does not reside exclusively within its holder. Once you realize that the person holding power actually holds that power within you—in your behavior—everything falls into place. Why? The holder of power exerts it over us when our actions depend on "what the power holder will think." When we act exactly as the power holder desires, that power is functioning. But if we act to the contrary, it means the power has no effect on us;

The Lawyer?
This is a complex issue. For some, a lawyer is an "unpleasant memory from the past"; for others, a lawyer is someone who "makes many promises but does nothing." Some distrust lawyers because they believe "the lawyer will always side with those who have a lot of money or influence." Some people's experience is associated with "wasted money," while for others, a lawyer is just a "silver-tongued schemer."

The Result?
A lawyer is not a "representative of the elite class" who is so detached from society that they are unreachable. "Come on, who has time for lawyers now?"—what does the author propose instead? "A lawyer listens first, and then protects you"—this is the baseline of legal advocacy. "The lawyer is the client's ally, not a decision-maker acting without them." "The lawyer acts solely in accordance with the client's interests." "The lawyer creates the case strategy and follows it," but it is the client who manages, agrees with, or rejects this strategy and its risks. "The lawyer controls the case, but the client controls the lawyer"—this is the fundamental principle of this profession. And yes, "not every case needs to go to court." Indeed, true success for a lawyer is often achieved when a case is "resolved without going to court."

Punishment by the System?
It is impossible to provide exhaustive answers to this issue in one short article or post, and that is not my goal. The goal is to show that the system is deliberately structured to look like a "mechanism of punishment where no one can save the individual." Through this perception, the system tries to ensure that the individual either does not dispute at all, or if they do, they fight "alone" without a lawyer, preventing any institutionalized trust between the individual and the attorney. The trust factor is vital because the legal profession is built not on ordinary trust, but on a "highly specialized relationship of trust."

Inaction as a Solution?
Every individual chooses their own path. This path is not easy, and someone who does not wish to fight for their rights should not be forced to. However, one thing is clear: action leads to results—good or bad—whereas inaction always leads to "bad." The result of inaction is "stress," "the shaking of faith in the rule of law," thoughts like "nothing will work out here anyway," or "I don't see a way out." No one in this world possesses the Holy Grail or a magic wand that solves everything. But action always yields a result. As the great Georgian poet Nikoloz Baratashvili eloquently wrote: even if a soul's striving is doomed, the effort is never in vain, and the path you have paved will remain;

In Conclusion?
The reader will surely ask, "So what is the solution, Mr. Lawyer?" I do not look for answers merely in the present; I rely on the historical genetics of which I am a child, and I trust the founding fathers. This state has many founding fathers, but one gave the nation the most crucial advice: "Movement, and only movement, gives strength and life to the country" (Ilia Chavchavadze). The legal interpretation of his words is: "Fighting for your rights is worth it, individual." Movement means moving forward, stepping onto this path. Taking a stand and continuing the journey requires willpower. No one is saying that an individual should detach from reality, but as another classic Georgian thought goes: "We must be the masters of our own destiny." Belonging to ourselves means being an individual who defends their rights;
