  • 5 Steps for Land Registration
  • This article addresses individuals who, for various reasons, have not yet been able to register their land plots, with or without adjoining structures. In one of the cases I personally litigated, I recall a client who withheld comprehensive information, including the fact that the case was already pending in court. Consequently, despite clear evidence confirming that the opposing party actually possessed a smaller plot area, the client failed to register the real estate because he inexplicably decided he could manage the process better without an attorney;
  • The challenges prevalent today are repercussions of various past periods, characterized by the absence of a unified database and/or the presence of erroneous and unverified data. Problems are most frequently encountered in relation to the so-called "yellow layer."
  • What is the "yellow layer"?
    In 1997, the Civil Code was adopted, which defined the functions of the Public Registry, necessitating the creation of a unified real estate database in its current form. Between 1998 and 2003, with the assistance of USAID, nationwide land surveying was conducted to establish a unified cadastral plan, which is currently represented by the "yellow layer." However, due to the massive scale of the project and insufficient human resources, the surveying and registration of land plots occurred with substantial flaws. Specifically:
  • True owners were not properly identified; property was simply registered under the name of whoever pointed to a specific building or land plot. In certain instances, identification data was entered incorrectly: for example, a person's name according to their passport might be "Temuri," but it was recorded as "Temo," or an entirely different name was assigned.
  • This is merely a brief list of the problems encountered during the registration process:
  • Step 1 – Although the law explicitly stipulates the obligation of the National Agency of Public Registry to independently search for title-establishing documents, it is highly recommended that you personally retrieve these documents (e.g., an extract from the household book, a gardener's logbook, an act of acceptance and delivery, or request information regarding the land taxpayer from the Revenue Service).
    Step 2 – If you intend to register land that belonged to a deceased family member (father, mother, grandfather, grandmother, etc.), it is imperative to first obtain a certificate of inheritance to formally establish yourself as the legal heir. Otherwise, you will not be able to register the land for one fundamental reason: you are not legally recognized as an heir (I have explained this in detail in the publication "Inheritance and Your Rights – What You Are Entitled to by Law"). Regarding the household book and the opening of an inheritance therein, entirely different rules apply, and standard inheritance procedures are not utilized; we will discuss this topic on another occasion.
    Step 3 – Once you have retrieved the relevant document or formally established your status as an heir, the subsequent stage is to prepare a cadastral measurement drawing and submit it to the National Agency of Public Registry.
    Step 4 – During the preparation of the cadastral drawing, the certified surveyor ought to provide you with information regarding the "yellow layers," specifically detailing whose rights are registered on the given plot, if any. Should an overlap with another person's registered data occur, it is necessary to request the registration data accounting card from the National Agency of Public Registry, which must indicate the legal basis upon which these data are registered. If the accounting card does not exist, it implies the data is nonexistent—meaning it is an erroneous record that can be easily annulled. However, if these data are legally protected, the problem falls into a completely different category.
    Step 5 – It is essential to strictly monitor the registration proceeding. This entails checking at least once a week to review the decisions made by the Public Registry, along with their underlying grounds and evidence. If you disagree with a decision, it is necessary to submit a corresponding legal opinion. If the Public Registry disregards your arguments, you have a 30-day statutory period to appeal the decision, first to a higher administrative body, and subsequently to the court. Before reaching this stage, it is strongly advised to consult a qualified jurist/attorney. You may also visit the National Agency of Public Registry to ascertain the detailed reasons for the refusal, as the Agency, acting as an administrative body, has not merely the right but the strict obligation to be objective, consider your motions, and request additional documents;
  • Regarding the court, litigating a dispute there involves an entirely different specificity, and professional assistance is highly recommended.
  • Furthermore, it must be considered that court proceedings are primarily contingent upon the documents and procedural steps you undertook during the administrative registration process. It is entirely possible that arguments you deemed correct during the registration proceeding could negatively impact the course of the judicial dispute. Consequently, it is significantly more effective to consult a qualified professional—specifically, an attorney—from the very beginning;
  • The scenarios described above represent the most frequent occurrences. Nevertheless, there may be myriad other complex details, ranging from an incorrect name or surname in the gardener's logbook to erroneous data in the birth certificate of a deceased family member. Accordingly, every case possesses its own unique legal specificity;
