Divorce and Property — Who is Entitled to What After a Divorce?

In legal terminology, marriage is a union or a legal transaction that generates mutual rights and obligations. The most fundamental aspect accompanying marriage is that it must be officially registered, as only a registered marriage generates mutual property rights (Article 1151 of the Civil Code);

A. Question: What happens when a marriage is not registered?
A. Answer: If a marriage is not registered—meaning the state has not recognized the validity of this marriage—upon separation, the parties do not accrue mutual obligations, including the right of joint ownership over acquired movable or immovable property. For instance, if a de facto "marriage" existed between the parties without registration, and one party purchased a vehicle, the other party does not acquire a co-ownership right to the purchased vehicle following the termination of the de facto "marriage."

B. Question: What happens if a prenuptial agreement exists between the parties?
B. Answer: If the parties have a registered marriage but have also executed a prenuptial agreement, precedence is given to the prenuptial agreement and the rules established therein. For example, if it is stipulated that the acquisition of specific real estate will not generate a right of joint ownership upon divorce, such a right will not arise. In this instance, the law grants priority to the prenuptial agreement;

C. Question: Does the right of joint ownership arise over gifted property?
C. Answer: If a spouse receives property, such as real estate, as a gift, the other spouse does not acquire a right of joint ownership over it upon divorce (Civil Code, Article 1161.1.b). This is due to the fact that a deed of gift is considered a personal transaction; no labor was exerted by the other spouse, and the gift is inherently linked to the personal attributes of the recipient spouse;

D. Question: Does the right of joint ownership arise over inherited property?
D. Answer: A spouse does not acquire a right of joint ownership over any asset received by the other spouse through inheritance (Civil Code, Article 1161.1.b). It is noteworthy that the law views both the right to receive gifts and the right of inheritance as personal rights, and therefore, does not extend the joint ownership regime to them;

E. Question: Does the right of joint ownership arise over property acquired before marriage?
E. Answer: The right of joint ownership does not arise over property acquired prior to the marriage. Here, the law takes a strictly pragmatic approach, based on the simple reason that the item was purchased before the creation of the family unit;

F. Question: Are there exceptions to the general rule? (Note: Labeled as 'დ' in the original text)
F. Answer: Yes, there are. For example, property received by either spouse (whether through a gift, inheritance, or acquired before marriage) may be deemed joint property if its value increased significantly during the marriage due to actions such as replanning, completion of construction, or remodeling. The law establishes this exception: if the property's value before marriage was, for instance, 5,000 GEL, and the construction was completed during the marriage bringing its current value to 15,000 GEL, this constitutes a significant change in value. However, how this "significant" figure is precisely determined depends on the specific circumstances of each case;

G. Question: Can these exceptional cases be misused or unlawfully exploited by one of the spouses? (Note: Labeled as 'ე' in the original text)
G. Answer: The answer is affirmative. I recall such a case from legal practice: one spouse was employed at a bank, while the other managed the household. The employed spouse purchased three real estate properties during the marriage, but executed the acquisitions as follows: the spouse's father would take out a loan, the father would pay the loan amount, and upon completion of the payments, the father would "gift" the real estate to his child. At first glance, this created the impression of a legitimate gift agreement; however, in reality, this real estate had to be deemed joint property, and the court ruled accordingly;
